Terms & Conditions

 
  1. The KLEEK App allows registered KLEEK members to make reservations for you and others (your Party) for tables at KLEEK-registered venues (Venues). We refer to this in these terms as a “Reservation” and to the person making the Reservation using the KLEEK App as the “Lead Booker”. All Reservations are made on the basis of, and governed by, these terms and conditions (Reservation Terms).
  2. Your agreement with KLEEK is for the provision of services relating to the Reservation. KLEEK will use reasonable endeavours to ensure that Venues honour any Reservations under the terms of our contract with the Venue and subject to these Reservation Terms. However, KLEEK do not own or operate the Venues and are not able to, and do not, guarantee availability of any table and shall not have any liability for failure by a Venue to honour a Reservation for any reason. In particular, please refer to clause 14 in relation to overbooking.
  3. In order to make a Reservation using the KLEEK App you will need to provide certain information including: (i) identity of the Lead Booker (ii) details of your Party including ratio of males to females (iii) arrival time and (iv) pre-ordered bottles as well as providing your payment information for the purpose of payment of the Minimum Charges. You warrant to us that all such information you provide will be complete and accurate.
  4. You must be a KLEEK member to make a Reservation; there is no automatic right to membership of KLEEK and we may refuse any application for membership in our absolute discretion. We may also alter terminate your membership or alter your membership tier and access score without notice at any time and without having to give any reason.
  5. For certain Reservations (as notified in the KLEEK App) the Lead Booker will be required to make a Reservation request for consideration by the Venue. This will require a completed KLEEK profile and Reservations may only be available to specific membership tiers. Completing your KLEEK profile may require provision of a profile picture and details of your occupation, music and crowd preferences and additional details of your Party.
  6. Reservations may be made using the KLEEK App on the night and typically up to seven days in advance. Outside these times any Reservations are strictly at our discretion.
  7. Upon making a Reservation the Lead Booker will be required to pre-authorise a payment card for the minimum table charge imposed by the Venue (as detailed in the KLEEK App) together with any pre-ordered bottles. We refer to these as the “Minimum Charges”. Pre-Authorisation is a temporary hold of a specific amount of the available balance on a credit / debit card which is not a charge. The full charge for the Minimum Charges is only processed once the Lead Booker is inside the Venue at their table as set out in clause 5 of these Reservation Terms.
  8. Upon arrival at the Venue the Lead Booker will be required to produce ID documentation matching the payment card used for the pre-authorisation of the Minimum Charges and to sign for the payment of the Minimum Charges. The full payment for the Minimum Charges will be charged when the Lead Booker is inside the Venue at their table. Payment of the Minimum Charges will be charged by KLEEK through our third party payment services provider, Stripe (https://stripe.com/gb). Whilst the KLEEP App may allow Reservations to be “group funded” by your Party in some situations, the Lead Booker remains liable to KLEEK for payment of the Minimum Charges.
  9. The Lead Booker will be required to allow the Venue to retain their payment card for security for the purpose of any further bottle orders and other charges incurred during the Reservation. Any such charges over and above the Minimum Charges will be made directly by the Venue and not via KLEEK. The final charges incurred by the Party during the Reservation over and above the Minimum Charges will be charged to the Leader Booker’s payment card at the end of the evening. Please note that under our agreement with the Venue any service charge added by the Venue is discretionary and may be removed at your request prior to processing the final payment.
  10. Venues may refuse entry or impose cover charges or entry fees for any additional guests over and above the Party specified in the Reservation at their discretion.
  11. Once a Reservation is made via the KLEEK App it is non-transferable and can only be cancelled up to 6 hours before the Reservation. In the event of cancellation less than six hours before the Reservation a “No-Show” fee will be charged as set out in clause 11 of these Reservation Terms.
  12. The Lead Booker must be at the Venue and ready to enter no later than 15 minutes from the time stated in the Reservation. If the Lead Booker is not ready to enter the Venue by this time then the Reservation shall be cancelled and the Venue may re-sell the table and a “No Show” charge of 10% of the Minimum Charges will be made to the Lead Booker’s payment card. Entry for any members of the Party who arrive before the Lead Booker is entirely at the discretion of the Venue and no pre-ordered bottles will be brought to the table until the Lead Booker has arrived and confirmed payment of the Minimum Charges as set out in clause 7. A larger “No Show” fee or non-refundable deposit may be charged for certain Reservations or in specific countries as notified in the KLEEK App prior to making the Reservation.
  13. In order to maintain the exclusivity of KLEEK and the Venues, all Venues reserve the right to refuse to allow entry to any Party or individual even if a Reservation has been made in the event of a failure by that Party or individual(s) to comply with the KLEEK Code of Conduct or any entry requirements imposed by the Venue. Depending upon the reasons for the refusal the Lead Booker and/or the Party may be barred from making future reservations at the Venue using KLEEK. In the event that the Lead Booker is refused entry, we may, at our discretion, attempt to arrange an alternative Reservation for your Party at an alternative Venue, in which case the Minimum Charges will be applied to that alternative Reservation; however, if we are unable to do so then the pre-authorisation of the Minimum Charges will be cancelled and no payment will be taken.
  14. The Lead Booker is responsible for ensuring that all members of your Party comply with the KLEEK Code of Conduct at all times whilst at the Venue. In the event of a breach of the KLEEK Code of Conduct you may be required to leave the Venue and no refund of the Minimum Charges or any other charges incurred by your party will be given.
  15. If a Venue has overbooked or is otherwise unable to honour a Reservation it is the responsibility of the Venue under the terms of our agreement with them to accommodate your Reservation with a replacement table. In the event of any issues or problems with this your first point of contact should be our “KLEEK Host” at the Venue (if one is present) or by text message to the KLEEK concierge desk available in the KLEEK App.
  16. Without prejudice to clause 14 of these Reservation Terms, the liability of KLEEK in relation to any Reservation under these Reservation Terms (including for breach of contract, negligence or otherwise) is limited to the amount of the payments due to KLEEK for the provision of the Services in respect of the Reservation (which the parties acknowledge will be part only of the Minimum Charges or No Show Fee as the case may be) and KLEEK shall not be liable for any consequential or indirect loss or damages. The limitations of liability in this clause shall not apply to liability for death or personal injury arising from the negligence of KLEEK or its employees or which otherwise cannot be excluded by law.
  17. In the event of any issues or problems arising with a Venue or a Reservation your first point of contact should be our “KLEEK Host” at the Venue (if one is present) or by text message to the KLEEK concierge desk available in the KLEEK App.
  18. The terms of our privacy policy from time to time, available on our website at [link] (Privacy Policy) are incorporated into these Reservation Terms by reference. By using the KLEEK App to make a Reservation, you acknowledge and agree that internet transmissions are never completely private or secure.
  19. To the extent that you provide any personal data in respect of any member of your Party other than yourself, you warrant and undertake that you are authorised by that person to provide such personal data for processing in accordance with the terms of the Privacy Policy.
  20. You agree and acknowledge that the conduct of your Party at a Venue may be noted and used to provide feedback which may be taken into account when using the KLEEK App for future Reservations and that Venues may, subject always to the Privacy Policy, be provided with personal data in relation to your Party which they may use when deciding whether to accept a Reservation or for other purposes reasonably relating to the Reservation.
